Legal Cost Consulting
preparing of bills
A bill of cost is an itemized list of expenses a party in a lawsuit or action needs to pay for services rendered by the lawyer. It should describe the nature of the work done by the lawyer for the client and list all expenses incurred.
To enable an Attorney to present the opposing party or his client with a bill of cost, the cost consultant captures his file in an honest, accurate manner in conjunction with the Rules as published in the Government Gazette, from time to time.
There are different types of bills:
- Party & Party Bills are presented to the unsuccesful party to indemnify the successful party’s legal cost
- Attorney & Client bills are presented to client as a summary of cost incurred on his / her behalf.

Claimants / Applicants aren’t always successful in their cases and may loose their case.
In this case the unsucessful party may be presented with a bill of cost, aimed at indemnifying the sucessful party for cost incurred in attending to the matter and court proceedings (litigation).
The unsuccesful party then has the right to object to any items listed on the bill of cost.
An opposition can be complicated and having an expert with your best interest at heart on your side, is invaluable.

In most cases the cost consultant will attempt to rather settle a matter to save their client extra time & cost.
But, in the event that the opposing party aren’t willing to settle or a fair settlement cannot be reached between the parties, the matter is set down for taxation in front of the Taxing Master at Court, whether High Court / Magistrate’s Court.
